15. Refund and Cancellation Policy

15.1 No Refunds Policy

All sales of our premium practice exams are final upon purchase. Due to the immediate digital nature of our content, we do not offer refunds once you have gained access to the course materials.

By purchasing, you:

• Acknowledge receiving immediate access to digital content
• Expressly consent to waive your statutory 14-day withdrawal right (§ 356 Abs. 5 BGB / EU Consumer Rights Directive Art. 16(m))

This policy is consistent with EU digital content regulations, which allow the withdrawal right to expire when digital content is delivered immediately with the consumer's express consent and acknowledgment.

15.3 Exceptions

We may consider refunds in the following exceptional circumstances:

• Technical Issues: Persistent technical problems preventing course access that our support team cannot resolve
• Duplicate Purchases: Accidental duplicate purchases of the same course
• Content Discrepancy: Course content significantly different from the description at time of purchase

To request an exception review, contact us at info@nex-arc-learning.com within 7 calendar days of purchase with your order details and a description of the issue.

15.4 Payment Processor Discretion

Lemon Squeezy, LLC ("Lemon Squeezy") acts as our Merchant of Record for all purchases. Lemon Squeezy retains discretion over refund decisions as per their buyer protection policies and may approve refunds in exceptional circumstances at their sole discretion.

This acknowledgment does not alter our policy above but recognizes that Lemon Squeezy, as the seller of record, may independently process refunds in accordance with their own policies and applicable consumer protection laws.

15.5 Course Access After Refund

If a refund is processed (whether through an exception or by Lemon Squeezy's discretion), your access to the purchased course will be immediately and automatically revoked. You will no longer be able to access the premium practice exam questions, explanations, or any associated course materials.

16. User Accounts

16.1 Age Requirements

Minimum Age:

• Free Practice Exams: 13+ years (in compliance with COPPA and GDPR age of digital consent)
• Paid Courses: 18+ years, OR 13-17 years with verifiable parental consent

By registering for a paid account, you confirm that you meet these age requirements.

16.2 Account Registration

To access paid courses, you must:

• Create an account with valid email address
• Provide accurate information
• Choose a secure password
• Verify your email address
• Meet the age requirements stated above

Account Security:

• You are responsible for maintaining account confidentiality
• Do not share login credentials

• We are not liable for losses from unauthorized use of your account

Account Termination:

We may suspend or terminate your account for:

• Violation of these Terms
• Fraudulent activity
• Sharing account credentials
• Chargebacks or payment disputes

Account Deletion Consequences:

• Deletion is permanent and irreversible
• All access to purchased courses is immediately revoked
• You cannot recover your purchase history or course progress
• No refunds are issued for deleted accounts (as per Section 15)

17. Course Access and License Terms

License Grant:

• Lifetime access (as long as platform operates)

Restrictions - You May NOT:

• Share your login credentials with others
• Download or redistribute course videos (unless explicitly allowed)
• Use content for commercial purposes
• Create derivative works
• Use automated tools to scrape or download content
• Resell or sublicense course access

Content Ownership:

• All course content remains our intellectual property
• You receive only a license to access, not ownership
• Trademarks, logos, and branding are protected
• Certification exam materials are based on publicly available specifications

Course Updates:

• We may update or modify course content at any time
• Updates provided at no additional cost
• We are not obligated to maintain specific content indefinitely
• Course structure and format may change

Platform Availability:

• We strive for 99% uptime but make no guarantees
• Scheduled maintenance may cause temporary unavailability
• We are not liable for interruptions outside our control
• No compensation for temporary service disruptions

Service Discontinuation:

In the unlikely event we discontinue our service:

• We will provide 90 days advance notice via email
• You will have the opportunity to download or archive your course materials during the notice period
• No refunds will be issued for "lifetime access" purchases made more than 14 days prior (EU withdrawal period)
• We will provide information about alternative exam preparation resources

20. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
